UNIVFY Inc. understands how important the privacy of Personal Information is to our clinic users. Univfy, a Data Processor in our commercial engagements with clinic users, processes data solely on behalf of each corporate client (the Data Controller) under their instruction and according to the Data Processing Agreement (UK, EU/EEA, Switzerland) or Business Associate agreement (US) and Canadian Privacy Agreement (Canada).

Univfy complies with the EU-US Data Privacy Framework (EU-US DPF), the UK Extension to the EU-US DPF, and the Swiss-US Data Privacy Framework (Swiss-US DPF) as set forth by the US Department of Commerce.

Univfy has certified to the US Department of Commerce that it adheres to the EU-US Data Privacy Framework Principles (EU-US DPF Principles) with regard to the personal data and the processing of personal data transferred (or received) from the European Union and the United Kingdom in reliance on the EU-US DPF and the UK Extension to the EU-US DPF.

Univfy has certified to the US Department of Commerce that it adheres to the Swiss-US Data Privacy Framework Principles (Swiss-US DPF Principles) with regard to the personal data and the processing of personal data transferred 9or received) from Switzerland in reliance on the Swiss-US DPF.

If there is any conflict between the terms in this privacy policy and the EU-US DPF Principles and/or the Swiss-US DPF Principles, the Principles shall govern. Univfy is subject to the investigatory and enforcement powers of the US Federal Trade Commission (FTC) and has chosen JAMS as our Independent Recourse Mechanism.

In compliance with the EU-US DPF, the UK Extension to the EU-US DPF, and the Swiss-US DPF, Univfy commits to referring unresolved complaints concerning our handling of personal data received in reliance on the EU-US DPF and the UK Extension to the EU-US DPF and the Swiss-US DPF to JAMS, an alternative dispute resolution provider based in the United States, the European Union, the United Kingdom and Switzerland.

If you do not receive timely acknowledgment of your DPF Principles-related complaint from us, or if we have not addressed your DPF Principles-related compliant to your satisfaction, please visit https://www.jamsadr.com/DPF-Dispute-Resolution for more information or to file a complaint. The services of JAMS are provided at no cost to you.

Access and Choice:

Individuals have the right to access the personal data that Univfy holds about them. You also have the right to limit the use and disclosure of your personal data. Onward Transfers and Liability:

In the context of an onward transfer, Univfy has responsibility for the processing of personal information it receives under the DPF Principles and subsequently transfers to a third party acting as an agent (also called subcontractor or subprocessor, such as enterprise cloud hosting providers like Amazon Web Services, AWS) on our behalf. Univfy shall remain liable under the DPF Principles if its agent processes such personal information in a manner inconsistent with the Principles, unless Univfy proves that it is not responsible for the event giving rise to the damage.

Under certain conditions, more fully described on the Data Privacy Framework website, you may be entitled to invoke binding arbitration when other dispute resolution procedures have been exhausted.
